1. General Terms and Conditions for All UsersAccount Creation / Profile

KarriereKind is an online platform where job seekers can create an account with their profile, and employers can then apply to the job seekers suggested to them by KarriereKind.

Employers specify which position needs to be filled. Depending on the contractual agreement, they receive profiles of suitable job seekers for the open position, enabling them to contact potential new employees. KarriereKind’s suggestions take into account not only qualifications and degrees but also personal preferences of the job seekers (e.g. preference for customer contact, teamwork, etc.) to ensure a good match between the requirements of the employer and the preferences of the job seeker.

Job seekers themselves decide which parts of their profile are visible to employers and to what extent they allow employers to contact them.

The initial contact is made via the online platform, where users can choose between chat and/or video call options.

2. Scope of the Terms and Conditions

The business relationship between KarriereKind and the user is governed solely by the following terms and conditions in the version valid at the time of contract conclusion. Deviating terms and conditions of the employer are not recognized unless KarriereKind explicitly agrees to their validity in writing.

The portal is operated by KarriereKind GmbH, represented by the Managing Director, located at Fürstenwall 178, 40215 Düsseldorf. The platform is intended exclusively for job seekers and employers searching for staff for their own organization. Use by commercial recruitment agencies is excluded.

KarriereKind reserves the right to exclude users from using the platform without providing reasons.

The platform is intended exclusively for users located in the Federal Republic of Germany.

For readability, gender-specific forms (male, female, diverse) are omitted. All terms referring to persons apply equally to all genders.

The following specific terms for job seekers and employers take precedence over the general terms if differing regulations are specified therein.

By using the online platform, the user confirms that they have read, understood, and accepted the Terms and Conditions.

 

2. Definitions

Job seekers are users who create a profile on the KarriereKind portal and are looking for employment.

Employers are companies, institutions, individuals, etc., who use KarriereKind to search for employees.

If a regulation in these terms applies to both job seekers and employers, the term “users” is used.

 

3. Warranty and Liability Disclaimer

KarriereKind does not guarantee success. In particular, KarriereKind is not obligated to present potential employment partners or ensure an employment contract is concluded.

KarriereKind only provides the online platform and the services explicitly stated in the contract. The extent to which job seekers and employers use the platform and provide accurate and complete data is beyond KarriereKind’s control and therefore not guaranteed.

KarriereKind strives to ensure uninterrupted operation of the platform. However, no guarantee is made that disruptions or downtimes will not occur. Interruptions may especially happen during maintenance work.

User claims for damages are excluded, except for damages resulting from injury to life, body, or health, or from breaches of essential contractual obligations (cardinal obligations), as well as liability for other damages caused by intentional or grossly negligent conduct of KarriereKind or its legal representatives or agents.

In case of a breach of essential contractual obligations, KarriereKind is liable only for the typical, foreseeable damage unless the claim is based on injury to life, body, or health.

The above limitations also apply in favor of legal representatives and agents of KarriereKind. They do not apply if KarriereKind or its agents act fraudulently or provide a guarantee.

 

4. Copyrights / Content Responsibility / Cookies

KarriereKind holds all copyrights and usage rights to the content and design of the portal, including layout, software, and all content created by or for KarriereKind.

Users may upload documents and data (“user-generated content”) after concluding a contract. KarriereKind does not endorse these contents and reserves the right to delete them entirely or partially without reason.

Users guarantee that their content is free of third-party rights and complies with applicable law. In particular, the General Equal Treatment Act must be observed. Irrelevant content (e.g. advertising, unrelated events, contests) must not be posted.

Users confirm that they own or have obtained all rights necessary for internet publication of their content. Copyright and brand notices must not be removed or altered. KarriereKind is not obligated to verify legal compliance of content.

Users indemnify KarriereKind from any claims arising from violations related to the content they post, including costs. KarriereKind will inform the user of any claims by third parties and allow them to participate in the defense.

Cookies may not be set by users. KarriereKind may delete any such content without notice. Repeated publication does not imply consent.

If KarriereKind is entitled to delete content, this does not affect any payment obligation under the contract.

Uploaded files are not checked for viruses or malware by KarriereKind. Users must not upload infected files. If such files are later discovered, users must inform KarriereKind within 24 hours.

If users set links to external websites, these must meet legal requirements (e.g. a valid legal notice/imprint). Only “no follow” links are allowed.

KarriereKind assumes no responsibility for compliance and is not obligated to monitor.

 

5. Data Protection

Provisions on data protection are available in the separate Privacy Policy. By using the portal, the user confirms that they have read and accepted this policy.

KarriereKind may use submitted data for analysis and statistics in accordance with the Privacy Policy.

 

6. Confidentiality and Personal Data Protection

KarriereKind and users agree to treat all information marked as confidential as such, even after termination of the contract.

They will ensure that confidential information obtained during the contract is protected technically and organizationally.

Exceptions apply for:

Only advisors bound by confidentiality and authorized employees may access such data.

Communication via the Platform

If users connect via chat or video call, they must not allow third-party access and must handle communication themselves.

Use of chat/video requires users to allow access to camera, speaker, and microphone.

 

7. Applicable Law / Jurisdiction / Dispute Resolution

Contracts are subject to German law excluding UN sales law. Mandatory provisions of the user’s country of residence remain unaffected.

If the user is a merchant, legal entity under public law, or a special fund under public law, the place of jurisdiction is Düsseldorf.

 

8. Other Terms

User rights under the contract are non-transferable. Third-party contract takeovers require KarriereKind’s consent.

If any clause is or becomes invalid, the remaining provisions remain unaffected. The parties will replace invalid clauses with a valid and reasonable alternative.

KarriereKind reserves the right to amend these terms and conditions.

Once the job seeker has completed their registration on the KarriereKind online platform and agreed to the Terms and Conditions and the Privacy Policy, they submit a binding offer to conclude a contract. The contract is formed when KarriereKind accepts this offer. Acceptance occurs either through the commencement of service execution and/or written confirmation.

The contract is concluded for an indefinite period. Both the user and KarriereKind may terminate the contract at any time without notice. Termination must be made in writing (email, fax, or letter).

The job seeker has no ownership rights to their account. The contract does not confer any ownership, usage rights, licenses, or other rights to KarriereKind’s software. Upon termination, the entire account will be deleted, although it may remain active for a short time due to technical limitations.

Profile (Creation, Editing, Deletion)

During account creation, the job seeker must provide their full name and a current email address. They may also upload documents (certificates, work samples, etc.) and answer questions about hard skills, soft skills, and core strengths.

The job seeker may select the desired level of profile anonymity:

The job seeker may update or supplement their profile at any time. If they are no longer available to the job market, they must delete their account immediately.

The job seeker controls which data and documents (e.g., certificates) are visible to employers.

The job seeker guarantees that all published content (or parts thereof) is free from third-party rights and complies with applicable laws.

Services Provided by KarriereKind

KarriereKind checks the entered data for potential compatibility between job seekers and employers. If a match is found, KarriereKind suggests the job seeker to the potential employer.

Direct communication takes place through the platform’s chat and/or video call features.

KarriereKind only provides the technical infrastructure and is neither authorized nor obligated to monitor or review chat/video content.

If no suitable employer or job has been suggested to the job seeker within three months, KarriereKind may notify the job seeker of potential profile improvements.

KarriereKind may also suggest coaching through a partner. The job seeker agrees to be contacted for this purpose. Any coaching contract is concluded with the partner, and their terms apply.

 

III. Special Terms and Conditions for Employers

 

Duties of the Employer

Contract Content / Conclusion / Duration

 

The contract content is defined in the respective order confirmation and associated documents, including the Terms and Conditions valid at the time of contract conclusion.

The contract is concluded when KarriereKind accepts the offer. Acceptance occurs with the start of service or written confirmation. Sending the invoice constitutes written confirmation.

The contract duration is based on individual agreements.

 

Payment Obligation

The employer agrees to pay the contractually agreed fee upon receipt of the invoice, no later than 10 calendar days thereafter. Payment is due upon contract conclusion.

Unless otherwise agreed, a fee of €199 (plus VAT) applies for posting a job advertisement.

KarriereKind is not obliged to provide services until full payment is received.

If the employer fails to pay after a reminder, KarriereKind may terminate the contract without notice. In this case, a compensation fee of 15% of the agreed total applies.

 

Contact Information

The employer must provide a current email address for communication with KarriereKind (especially for contractual documents) and notify KarriereKind of any changes. They must also whitelist KarriereKind to avoid spam filtering.

 

Information / Documentation

The employer must promptly provide all necessary documents and information required for the execution of the contract.

In particular, job descriptions must comply with legal requirements (e.g., General Equal Treatment Act). KarriereKind is not obligated to verify compliance but may delete content if violations are discovered. Payment obligations remain unaffected.

 

Account Creation / Profile

Each employer may create only one account. They choose their username and password freely and must keep login data confidential. Any misuse must be reported immediately.

KarriereKind disclaims all liability for misuse of password-protected accounts.

The employer must provide truthful and complete profile information. If KarriereKind becomes aware of false data, it may terminate the contract immediately, delete the account, and exclude the employer.

The employer may update, supplement, or delete their profile at any time. Deletion does not entitle a refund of paid fees.

The employer guarantees that all posted content (or parts thereof) is free from third-party rights and complies with applicable laws.

 

Services Provided by KarriereKind

KarriereKind checks the provided data to identify possible matches between job seekers and employers. If a match is found, KarriereKind proposes the job seeker to the employer (match suggestion).

KarriereKind is only obligated to search for potential job seekers and does not guarantee success.

If the employer wishes to contact a proposed job seeker, KarriereKind transmits the employer’s provided information to the job seeker.

Whether the job seeker agrees to be contacted is outside of KarriereKind’s control; therefore, no success is guaranteed.

If the job seeker consents to contact (match), KarriereKind enables chat and/or video communication between the parties.

If job seekers repeatedly decline contact with the company, KarriereKind may offer the employer additional services to increase success. These are charged separately based on the current price list.

 

Additional Services

Additional services may be agreed upon individually.
